Terms and Conditions

These Terms and Conditions apply to all sales of products supplied by The Penetrometer Specialists ("we", "our", "us").

1. General

By placing an order through this website, you agree to these Terms and Conditions.

We reserve the right to update these Terms and Conditions at any time.

2. Pricing

All prices are shown in New Zealand Dollars (NZD) and are exclusive of GST unless otherwise stated.

Freight and delivery charges are additional unless specifically included.

2.8 Calibration

Where applicable, products supplied by The Penetrometer Specialists may be calibrated prior to dispatch.

It is the responsibility of the customer and equipment operator to verify that any calibration remains valid and appropriate before undertaking testing or relying on test results.

Equipment may require periodic inspection, maintenance, adjustment, or recalibration to ensure continued accuracy. The customer is responsible for determining whether calibration is required for their intended application and for maintaining any calibration records required by their organisation, client, or governing standards.

Unless explicitly stated in writing, products are supplied without formal calibration certification.

3. Payment

Payment must be received in full prior to dispatch unless a credit account has been approved.

Ownership of goods remains with The Penetrometer Specialists until payment has been received in full.

4. Delivery

Delivery times are estimates only and are not guaranteed.

We are not responsible for delays caused by freight providers or circumstances outside our control.

Risk in the goods passes to the customer upon delivery.

5. Inspection of Goods

Customers should inspect goods upon receipt.

Any shortages, damage, or incorrect items must be reported within 7 days of delivery.

6. Returns and Warranty

Faulty goods will be repaired, replaced, or refunded in accordance with the Consumer Guarantees Act 1993 where applicable.

Returns for change of mind may be accepted at our discretion and may be subject to a restocking fee.

Returned goods must be unused and in original condition.

Normal wear and tear is not covered by warranty. Wear resulting from misuse, abuse, modification, corrosion, impact damage, improper maintenance, or use with incompatible equipment is not covered by warranty.

7. Product Use and Suitability

The customer is responsible for determining the suitability of any product for its intended use.

The Penetrometer Specialists supplies geotechnical equipment and replacement parts but does not provide engineering, geotechnical, or design advice unless expressly agreed in writing.

Users are responsible for ensuring equipment is used safely and in accordance with applicable standards, procedures, and workplace requirements.

Products supplied by The Penetrometer Specialists are intended for use by suitably trained personnel. The customer is responsible for ensuring equipment is operated safely and in accordance with all applicable health and safety requirements.

8. Limitation of Liability

To the maximum extent permitted by law, our liability for any claim relating to products supplied is limited to the purchase price of the goods concerned.

We shall not be liable for any indirect, consequential, special, or economic loss arising from the use of our products.

9. Intellectual Property

All website content, product photographs, drawings, specifications, and branding remain the property of The Penetrometer Specialists and may not be copied or reproduced without written permission.

10. Governing Law

These Terms and Conditions are governed by the laws of New Zealand.

Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.
